  [JURIST] The Supreme Court of Canada [official website] ruled [judgment] Thursday that a term of good faith performance is now an implied requirement in all contractual agreements. The court found that Canadian courts' resistance to ruling on the issue of good faith performance in contracts has created an "unsettled and incoherent body of law ... which is difficult to analyze." The court laid out two steps to resolving the issue:   The first step is to acknowledge that good faith contractual performance is a general organizing principle of the common law of contract which underpins and informs the various rules in which the common law, in various situations and types of relationships, recognizes obligations of good faith contractual performance.   La Sala Segunda del Tribunal Supremo ha abierto una causa contra los ex presidentes de la Junta de Andalucía Manuel Chaves y José Antonio Griñán por el caso de los ERE presuntamente irregulares.   Con el informe favorable de la Fiscalía, la Sala de lo Penal del Supremo ha asumido también la investigación sobre los exconsejeros José Antonio Viera y Gaspar Zarrías, en su calidad de diputados del Congreso como hace con Chaves,; y de la también exconsejera de Andalucía Mar Moreno, en su calidad de senadora, como hace con el expresidente José Antonio Griñán.   Britain’s first judge at the international criminal court (ICC) has said he fears it may become “institutionally lopsided” as the result of changes proposed by the court’s registrar.   In a public lecture delivered at Chatham House last week, Sir Adrian Fulford, who served at the court from 2003 to 2012, expressed concerns that defendants and victims would be left insufficiently represented while very considerable power remained with the prosecutor.   The judge, who now sits as Lord Justice Fulford in the court of appeal for England and Wales, said the department that represented victims at the court had been his brainchild.   El ministro de Justicia, Rafael Catalá, se ha reunido este jueves con los representantes de las comunidades autónomas con competencias en Justicia, a quiénes ha asegurado colaboración para acometer las reformas de la Justicia esta legislatura. En este sentido, ha asegurado que ante el poco tiempo que resta de legislatura,se priorizan la reforma de la Ley Orgánica del Poder Judicial y de la Ley de Enjuiciamiento Criminal, de la que se modificarán sólo aspectos puntuales.
