USA – Supreme court says FTC can sue over deals that delay generic drug sales

  The Supreme Court ruled on Monday regulators can challenge deals between brand-name drug companies and generic rivals that delay cheaper medicines from going on sale, which regulators say increase costs to consumers by billions of dollars.   But the court, in a 5-3 vote with Justice Samuel Alito recused, declined the Federal Trade Commission's request to declare the deals to be presumed to be illegal. The regulatory agency has fought the practice for more than a decade.   "While we believe the Supreme Court decision will open the door to broader FTC scrutiny of brand/generic settlements, we believe a majority of settlements will still be allowed even if reviewed by the FTC," JP Morgan analyst Chris Schott said in reaction to the ruling.   The companies in the case were brand-name…

UK – Police acted unlawfully after kettling cuts protesters, high court rules

USA – In Miranda case, Supreme Court rules on the limits of silence

  Crime suspects need to speak up if they want to invoke their legal right to remain silent, the Supreme Court said Monday in a ruling that highlights the limited reach of the famous Miranda decision.   The 5-4 ruling upheld the murder conviction of a Texas man who bit his lip and sat silently when a police officer asked him about the shotgun shells that were found at the scene of a double slaying. They had been traced to the suspect's shotgun.   At his trial, prosecutors pointed to the defendant's silence as evidence of his guilt. USA – Justices invalidate Arizona voter registration law

  In a 7-2 vote, the court, in an opinion written by conservative Justice Antonin Scalia, ruled the voter registration provision of the 2004 state law was trumped by a federal law, the 1993 National Voter Registration Act.   The state law was opposed by the Mexican American Legal Defense and Education Fund and Indian tribes. UK – Legal aid cuts will drive out the best lawyers, supreme court president warns

  Plans to cut £220m more from the legal aid budget are regrettable, will "drive out the best lawyers", and may not produce significant savings, the UK's most senior judge has warned.   In his most explicit challenge yet to government reforms, Lord Neuberger, president of the supreme court, implied that access to justice for all – particularly "the poor, the vulnerable [and] the disadvantaged" – is being put at risk.   Lawyers can be split into two branches of the profession, not barristers and solicitors, the 65-year-old judge suggested, but "lawyers who serve rich individuals and companies, and lawyers who serve ordinary citizens". Brasil – CJF regulamenta remoção nacional de juízes federais

A remoção nacional entre juízes federais de diferentes regiões e a remoção ou permuta entre regiões para acompanhar cônjuge foram regulamentadas pelo Conselho da Justiça Federal (CJF), em sessão realizada no dia 27 de maio. A remoção de juízes federais titulares ou substitutos de outras regiões somente será possível após a realização de remoções e promoções no âmbito interno de cada região, se mesmo assim subsistirem vagas e o Tribunal Regional Federal (TRF) respectivo não decidir promover concurso público para seu provimento.   Começou nesta semana, no Rio Grande do Norte, um mutirão que pretende solucionar, até o final deste ano, 1.350 processos de improbidade administrativa e crimes contra a administração pública. A medida visa garantir o cumprimento da Meta 18, aprovada pelos presidentes de todos os tribunais brasileiros, no VI Encontro Nacional do Poder Judiciário, promovido em novembro de 2012 pelo Conselho Nacional de Justiça (CNJ).
