USA – Survey: Firm Leaders Admit Downturn’s Permanent Impact

Notícias
Most law firm leaders admit that recession-driven changes to both their pricing practices and their clients' expectations that work be done efficiently are likely here to stay, according to a new survey from legal consultancy Altman Weil. At the same time, a majority of firm leaders responding to Altman Weil's fifth annual Law Firms in Transition Survey, which was released Tuesday, acknowledge being slow to alter their long-term strategies to address those changes.   The survey queried firm leaders at 238 firms—all of which have at least 50 attorneys—on legal industry trends, as well as on issues related to law firm growth and economic performance. Thirty-four percent of the respondents came from within the ranks of The Am Law 200.   Of the survey's respondents, 95.6 percent said they view increased…

US lawmakers urge media shield law

Notícias
A bipartisan group of lawmakers from the US House of Representative advocated Wednesday for a law that would shield the press from giving information to a federal entity unless certain conditions are met. The push for legislation [Politico report] comes in response to an incident in which the US Department of Justice (DOJ) obtained journalists' records. In a press conference, Representative Ted Poe (R-TX) called the DOJ's search[The Hill report] for the source of leaked information in April and May 2012 "a massive intimidation fishing expedition." The new legislation would prevent the DOJ from taking such actions unless it was in the interest of preventing potential harm to national security or an act of terrorism. Similar to the Free Flow of Information Act [text], the bill would give journalists some protections from penalties for refusing…

UK – Lawyers protest outside parliament against legal aid cuts

Notícias
Standing in front of a coffin marked: "RIP legal aid," hundreds of lawyers – many in wigs and gowns – demonstrated outside parliament on Wednesday.   The protesters oppose government plans to cut £220m from the annual budget for criminal legal aid and remove defendants' rights to choose their solicitor.   Sadiq Khan, a former solicitor and Labour's justice spokesman, accused the justice secretary, Chris Grayling, of destroying legal aid.   He said Grayling's "obsession with throwing red meat to Tory backbenchers and appearing on the front page of the Mail on Sunday" would undermine British justice.   Among others supporting the protest were the Blur drummer David Rowntree, Lady Kennedy, the legal campaigner Clive Stafford-Smith and Gerry Conlon, who was one of the Guildford Four. As many as 500solicitors and barristers took…

UK – Legal aid tendering: will it actually work?

Notícias
Planned legal aid reforms are causing "deep anxiety" to solicitors andbarristers, the senior government official responsible for them told me on Tuesday evening.   Dr Elizabeth Gibby, head of legal aid policy at the Ministry of Justice, was answering questions at the first in a series of open meetings arranged by the department and advertised, very discreetly, on its website. This one took place at a hotel in Reading and attracted more than 100 lawyers; there are to be another 12 this month around England and Wales.   "We appreciate that the proposals [in Transforming Legal Aid] are causing deep anxiety and concern," Gibby said, "and people have genuine worries about aspects of the [reform] model. That's why we genuinely want to hear from people. I know people often think that responding to government…

France – French court questions IMF chief Christine Lagarde

Notícias
She has been asked to explain her handling of a dispute in 2007 which resulted in some 400m euros (£342m; $516m) being paid to Bernard Tapie.   Ms Lagarde insists the award was the best solution at the time.   She has now left the court, which investigates ministerial misconduct, with no immediate decision announced.   The IMF chief departed the Court of Justice of the Republic shortly after 19:00 GMT, telling reporters "until tomorrow". She could be placed under formal investigation for the decision to use arbitration, against advice from senior advisers, to settle a long-running court battle between the state and Mr Tapie, a supporter of the then French President, Nicolas Sarkozy.   Financial probity examined Mr Tapie won a much bigger payout than he might have…

UK – Should parliament give itself more powers?

Notícias
Should parliament give itself more powers? That's the intriguing question posed by a paper to be published next week by the Constitution Society, an educational charity established five years ago.   As a matter of constitutional theory, the powers of parliament are unlimited. Subject to royal assent – which is regarded as a formality – the Commons and Lords acting together can pass any laws they like.   What we are talking about here are the so-called privileges of parliament, the best known of which is freedom of speech. The question addressed by the paper is whether those privileges should all be codified into a new act of parliament.   The arguments are finely balanced. On the one hand, parliamentary privileges are unclear and surprisingly limited. On the other hand,…
