  Me cuesta escribir estas líneas, sobre quien en mi imaginario personal, y en el de muchos discípulos, era inmortal, como en realidad lo seguirá siendo a través de su obra, discípulos y, al final, como final también de una época siempre recordable, de quienes en la vieja Europa representaba un hombre integral, un arquetipo humano inigualable. España – Moliner solicita más medios en la apertura del nuevo curso judicial

El presidente del Tribunal Supremo (TS) y del Consejo General del Poder Judicial (CGPJ), Gonzalo Moliner, ha asegurado, este lunes, que los jueces españoles no cuentan con la “adecuada dotación de medios personales y materiales que dan completa cobertura al ejercicio de su función” y ha recordado al poder ejecutivo y legislativo que “la eficacia y eficiencia” de la justicia pasan por la adopción de medidas que permitan una organización judicial “adecuada” y con los medios “suficientes” para llevar a cabo su labor. España – El Gobierno aprueba el Proyecto de Ley General de Telecomunicaciones

  El Consejo de Ministros ha aprobado la remisión a las Cortes Generales del Proyecto de Ley General de Telecomunicaciones, según se refleja en la reseña de su última reunión.   Según el texto hecho público, la Ley actualiza la normativa vigente, que data de 2003, para adaptarla a los profundos avances que ha vivido el sector de las telecomunicaciones y para favorecer el desarrollo futuro de la economía digital, que el Gobierno considera uno de los pilares económicos con más potencial de crecimiento en España.   La nueva Ley pretende, igualmente, crear el marco adecuado para facilitar las inversiones necesarias para el desarrollo de esta economía digital, eliminando barreras y fomentando la competitividad y la protección del usuario. UK – Barclays fined £50m for ‘reckless’ behaviour during 2008 fundraisings

  Barclays revealed on Monday that it is contesting a £50m fine by the City regulator, which claims the bank behaved "recklessly" in the controversial 2008 fundraisings that allowed it to avoid a taxpayer bailout.   As Barclays formally launched its £6bn cash call and admitted its investment banking earnings were "significantly" lower than a year ago, the bank provided more details about the investigation by the Financial Conduct Authority and Serious Fraud Office into the way it disclosed details of fees to the Middle Eastern investors who backed its two fundraisings at the height of the financial crisis five years ago.   There was no statement from the FCA on Monday but Barclays said the regulator intended to levy one of its largest ever fines of £50m, only a year after Barclays incurred what was then a…

UK – Investigated Serco and G4S can bid for new contracts, says Chris Grayling

  The justice secretary is to allow two security companies to bid for Ministry of Justice contracts despite both facing alleged fraud investigations overexisting deals.   Chris Grayling has not ruled Serco and G4S out of the running for new MoJ contracts, which include the £800m privatisation of most probation services.   But he has for the first time assured his Labour counterpart, Sadiq Khan, that no new contracts will be awarded to either company until a series of official "forensic audits" has given them a clean bill of health.   The official publication of invitations to bid for the privatisation of the bulk of the probation service is due soon. EU Rejects German Request to Review Telefonica-KPN Deal

  Telefonica SA (TEF) and Royal KPN NV (KPN)’s proposal to combine their German assets will be reviewed by the European Union, the bloc’s antitrust chief said today, rejecting a bid by Germany to take over the regulatory analysis.   EU Competition Commissioner Joaquin Almunia’s comments in Florence, Italy, are a blow to German regulators concerned that Telefonica’s purchase of KPN’s E-Plus unit would reduce the number of mobile phone providers in the country from four to three.   The Telefonica acquisition, valued at 8.55 billion euros ($11.36 billion), is one of two deals that may transform the German telecommunications industry once dominated by Deutsche Telekom AG. Spain lawmakers advance transparency law to fight corruption

[JURIST] Spanish lawmakers on Thursday passed amendments to Spain's freedom of information law that aim to combat political corruption. The amendments, which increase accountability for the use of public funds [Reuters report], include political parties, the royal family, lobbies, unions and employers' associations. The new law will require all levels of government to provide clear public records concerning which companies have government contracts. The current transparency law [text, in Spanish] has been criticized for lacking these key features. Currently, Spain is the only EU country without a law guaranteeing citizens a right to information on how public funds are spent. Brasil – Senado aprova PEC da perda automática de mandato

  O Senado aprovou nesta quarta-feira (11/9), em dois turnos, a proposta de emenda à Constituição que estabelece a perda automática de mandato em caso de condenação de deputados e senadores que culmine na suspensão dos direitos políticos. Em casos de improbidade administrativa, a PEC estabelece que a perda automática de mandato ocorrerá apenas quando o Judiciário determinar a perda da função. UK – Minister calls for special planning court to speed up major projects

  A specialist planning court should be established to speed up development projects and drive out "meritless" objections, the justice secretary, Chris Grayling, has proposed.   In a revised consultation on reforming judicial review cases, the Ministry of Justice also calls for tougher restrictions to prevent charities and campaign groups from launching challenges unless they are directly involved in issues.   Those who make unsuccessful claims should in future face higher costs, it is suggested, while appeal cases deemed by the government to be important may be allowed to leapfrog the court of appeal and go straight to the supreme court.   Grayling said: "These proposals will ensure legal challenges are heard swiftly, so crucial new building projects no longer fall by the wayside because of needless delays.   "We want to make…
