UN rights experts urge stronger protection of journalists

Notícias
[JURIST] A group of UN human rights experts, including the UN Special Rapporteur on Freedom of Opinion and Expression, urged stronger protection [press release] Monday for journalists covering conflicts. The group said recent attacks, kidnappings, and arbitrary incarcerations need to be condemned and opposed by the international community. The experts stressed that "journalists covering armed conflicts do not lose their status as civilians; they are not participants in the conflicts they cover. As such, they continue to be protected by the applicable guarantees under human rights law and international humanitarian law." The group highlighted that reports indicate over sixty journalists have been killed in the past three years in Syria alone, and several journalists have been killed during the recent violence in Gaza. The experts called for an open and committed…

China Says Hong Kong Democracy Protests Risk Election

Notícias
China defended a plan to place limits on democracy in Hong Kong, calling on opposition lawmakers to get behind its ruling or risk losing the chance to elect the city’s next leader by popular vote.   Activists should overcome their “prejudices” and see that China’s proposal is the most concrete step toward implementing the election, Li Fei, deputy secretary-general of the National People’s Congress, said in Hong Kong today. Earlier, police used pepper spray to repel protesters who sought to break through barricades as Li presented the plan to a gathering of lawmakers and business leaders.   China’s demand to vet candidates for the 2017 election angered pro-democracy lawmakers and activist group Occupy Central With Love and Peace, which said it will organize protests culminating in the mass occupation of Hong Kong’s…

USA – Obamacare’s Latest Threat Nears Turning Point in Court

Notícias
Two years after a single vote on the U.S.Supreme Court saved a core part of Obamacare, opponents are trying to topple the measure again, this time using a four-word phrase in the law.   A disputed provision in the Affordable Care Act suggests that millions of Americans can’t get the tax subsidies created by the law to reduce the cost of health insurance.   All sides are now waiting for a federal appeals court in Washington to make a procedural decision that will have outsize implications. The announcement could come any time.   President Barack Obama’s administration wants the court, known as the D.C. Circuit, to set aside a three-judge panel’s ruling against the subsidies and rehear the case. A refusal to do so would leave appeals courts in disagreement on…

USA – Ex-Porsche CEO Wiedeking to Be Tried for VW-Share Manipulation

Notícias
Former Porsche SE Chief Executive Officer Wendelin Wiedeking must stand trial over the company’s failed bid to use options to acquire Volkswagen AG, a Stuttgart appeals court ruled.   The ruling overturned a decision by a lower court in April that said there wasn’t enough evidence to pursue the case, Stefan Schueler, spokesman for the appeals tribunal, said in an e-mailed statement today. Ex-Chief Financial Officer Holger Haerter also has to stand trial.   Porsche has faced a series of investigations and lawsuits since disclosing in October 2008 that it had access to 74.1 percent of Volkswagen AG, partly through cash-settled options, and was seeking to acquire 75 percent as part of a takeover strategy. The announcement caused Volkswagen’s stock to jump as short sellers raced to buy shares…

[JURIST] The US Department of Justice (DOJ) [official website] on Thursday announced a $16.65 billion settlement [press release] with Bank of America (BOA) [corporate website] to settle claims that it sold precarious mortgage-backed securities to investors. Of the $16.65 billion, $9.65 billion will be split among federal and state entities while the remaining $7 billion will be paid to consumers harmed by BOA and Countrywide Financial's contribution to the 2008 financial crisis. Attorney General Eric Holder [official profile] said that "This historic resolution—the largest such settlement on record—goes far beyond 'the cost of doing business.' Under the terms of this settlement, the bank has agreed to pay $7 billion in relief to struggling homeowners, borrowers and communities affected by the bank's conduct. This is appropriate given the size and scope of the wrongdoing at issue." Associate Attorney General…
