USA – Obama threatens to veto proposed health care changes

Notícias
[JURIST] A White House [official website] spokesperson said Wednesday that US President Barack Obama would veto proposed legislation [statement, PDF] that would reinstate the 40-hour work week requirement for employer health care coverage. The Patient Protection and Affordable Care Act (ACA) [text, PDF] reduced the original 40-hour work week requirement to 30 hours in order to ensure more Americans would be covered by employers, but supporters of Save American Workers Act [HR 30 materials] argue the opposite has occurred. Supporters of the bill argue that the ACA has caused many employers to cut employee work hours in order to avoid having to cover those employees that met this threshold. The Congressional Budget Office estimated that it would cost taxpayers 47.5 billion dollars to shift back to a 40-hour work week requirement. The White House said the bill…

International law is coming up short in its response to climate change

Notícias
When it comes to human suffering, the IPCC doesn’t mince its words. According to its latest report – the culmination of seven years of research and intense negotiations – climate change is on its way to causing “severe, pervasive and irreversible” damage on the world’s people, cultures, ecosystems and economies.   The report identifies a series of imminent risks, including illness, the breakdown of infrastructure and public services, food and water insecurity, and loss of rural livelihoods.   The human cost of global warming has a name: climate injustice. The remedy, then, is climate justice. Climate justice is not just the recognition that climate change is a matter of human rights and development; it also involves recognising that the victims of global warming are not responsible for it, nor can…

[JURIST] A judge for the US District Court for the Northern District of Florida [official website] ruled [order] Thursday that Florida county clerks have a legal duty to issue marriage licenses for same-sex couples, while also noting that they are not ordered to do so. This ruling clarifies a stay on the August district court decision [opinion, PDF] that declared the Florida same-sex marriage ban unconstitutional [JURIST report]. US District Judge Robert L. Hinkle had stayed the decision to allow the defendants time to appeal the ruling and seek a further stay.

USA – Credit Suisse Told to Face New York’s Mortgage-Fraud Claims

Notícias
Credit Suisse Group AG (CSGN) was ordered to face a lawsuit by New York’s attorney general accusing the bank of fraud in sales of mortgage-backed securities before the recession.   A New York State Supreme Court judge rejected the bank’s request to dismiss the lawsuit, which demands as much as $10 billion in damages. Attorney General Eric Schneiderman’s suit was valid, and he demonstrated the bank may have engaged in misconduct, Judge Marcy Friedman said in yesterday’s decision.   The ruling may strengthen Schneiderman’s hand in punishing other banks in the future over liability for the financial crisis.   “We will appeal this particular decision and continue to defend ourselves in this case,” Drew Benson, a spokesman for Zurich-based Credit Suisse, said in an e-mail today.   Schneiderman sued Credit…
